Nairobi will take longer to increase daily parking charges from Sh140 to Sh300 after Public Service Vehicle (PSV) operators won a stay of the order allowing the review.
Nairobi County government had planned to effect the new charges on January 2, 2014 following the Wednesday judgement, but the operators yesterday filed a notice of appeal.
High Court judge Issack Lenaola, who on Wednesday allowed the increase, on Thursday set the case for hearing on January 13 — giving motorists a two-week reprieve.
“There will be a stay of execution or further execution of the content of paragraph 6.1 of the schedule to the Nairobi County government Finance Act 2013 pending hearing on January 13, 2014,” ordered Mr Lenaola.
Matatu operators want the increase suspended until their appeal against dismissal of their earlier suit is heard.
The case dismissed on Wednesday had sought to declare the section of the Nairobi County Finance Act illegal and the charges exorbitant.
The petitioners said they would suffer huge financial loss if the appeal was successful.
A spokesman for Governor Evans Kidero had on Wednesday said the new charges would take effect on January 2.
City Hall has increased collections from parking to Sh60 million per month from Sh100 million. It had hoped that the higher charges would help achieve a target of Sh150 million per month or Sh1.8 billion per year from the revenue stream.
The new charges would raise the monthly parking bill to Sh7,200, assuming a six day week.
Motorists have the option of buying a Sh5,000 ticket, up from Sh2,000, for a month’s parking in the Central Business District, Westlands, Upperhill, Community, Ngara, Highridge, Industrial Area, Gigiri, Kilimani, Yaya Centre, Milimani, Hurlingham, Lavington and Karen.
Off street parking in places like Pangani, Muthaiga, Eastleigh and Lang’ata Road would remain at Sh200 per day.
Matatus and lorries would pay the new fees depending on capacity with 14 to 42-seater minibuses paying Sh8,000, up from Sh4,000, and buses above that capacity Sh10,000.
The parking fees are some of the enhanced charges under the Finance Act, most of which were effected in October. Land rates will also be increased in January.Other enhanced charges like land rates will come in effect at the same time.
